What Is the Issue?

Often times, parties wanting to leave a marriage look to remove money or other assets out of joint bank accounts for any number of reasons before moving on. A percentage of those people, however, will empty bank accounts, cancel insurance policies and/or engage in other similar behavior at the expense of the other spouse and/or children of the marriage which gives rise to two questions. First, may a departing spouse transfer assets or cash out of joint bank accounts in anticipation of or after an action to dissolve the marriage has been started? Second, does a financial representative, such as a banker or other investment professional have any kind of duty to protect an asset from being commandeered by the departing spouse at the loss of the spouse left behind?
