[Fredslist] question regarding SS none resident and ESRD

I have been working with Social Security with a client since the summer with
no end at sight.
The client is working in the US with a work visa since 1999, and have been
paying into the US Social Security
He does not have a green card (legal residency) status. 
He is a citizen of Bermuda/Canada
He has ESRD
 
Every time we talk to the local social security office all they do is ask
for another copy of his work visa. 
 
Questions for anyone with intimate knowledge of US Social Security rules: 
                Is this person eligible to receive social security benefits
and Medicare? 
                Would ESRD override the none residency status?
