Also under New York Social Services Law, a temporary spousal support application must now consider the payor spouse's first $524,000.00 in annual income - an increase of $24,000.00 from the $500,000.00 cap provided for in the original statute.


Why is this a concern to you and/or your clients? In New York, income for child and spousal support includes all income that was or should have been reported in the parties' most recent federal tax returns. Thus, if your client is receiving trust income, even if that trust is otherwise separate property for equitable distribution purposes, that income is subject to a child support calculation.
