as incorrectly classifying workers in terms of how they get paid.  

*	A company views a group of workers as independent contractors,
but the government later determines that they are all employees. 
*	An employer believes that an employee is "exempt" under overtime
law, but a court later finds that the employee was actually entitled to
overtime pay throughout five years of employment. 

In situations such as these, the costs to the employer in back pay and
penalties can be staggering.  While you may have read about the Fortune
500 companies that have paid out massive settlements due to
classification errors, smaller employers have also been subjected to
numerous audits and lawsuits that have resulted in thousands of dollars
in penalties and legal fees.
