[Fredslist] Attorney Questions re: Unemployment Benefits

All,

I have a friend who took $2,500 in unemployment benefits at a time when he was at a commission only job that made no commission during the time he applied for unemployment.  He did not know that he could not claim such benefits.  He received a letter from the Unemployment Board stating he needed to repay his benefits and that he willfully made false statements to obtain such benefits. He sent in an appeal and will have to appear before the Appeal Board.  He is willing to pay back the money, but they want a sum that would be a hardship for him to re-pay at this time.  Does anyone know if he can argue hardship at the appeal hearing.  Also, at present, there is no criminal charge being lodged. Does anyone know if he could be brought up on criminal charges.  Any insight would be most appreciated.
